Terms of Service

Last updated: October 31, 2026

1. About these terms

These Terms of Service govern your use of ToolShare’s website, applications, and related services (the “Platform”). By creating an account or using the Platform, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Platform. These Terms do not remove rights that cannot be excluded under applicable law.

“ToolShare”, “we”, and “us” refer to the operator of the Platform. The Platform is intended to be used in accordance with applicable Indian law, including consumer protection, e-commerce, information technology, data protection, contract, and other laws that apply to your use.

2. Eligibility and accounts

  • You must be at least 18 years old and legally capable of entering into contracts to use the Platform.
  • Provide accurate account and profile information, keep your credentials secure, and promptly update information that changes.
  • You are responsible for activity on your account. Tell us promptly if you suspect unauthorised access.
  • We may restrict or suspend access for safety, fraud prevention, legal compliance, or material breach, and will provide information about the action where appropriate.

3. Tool listings, rentals, and returns

  • Owners must have the right to offer an item, provide accurate descriptions and photos, disclose known defects, set a clear rental price and availability, and make the item reasonably safe for its stated use.
  • Borrowers must review the listing and agreed dates, inspect the item at handoff, use it lawfully and as intended, follow safety instructions, and return it on time in the agreed condition, allowing for ordinary wear.
  • Do not lend, rent, transfer, or use an item in a way that the owner has not authorised. Do not list stolen, illegal, recalled, or unsafe items.
  • The parties should record the item’s condition at pickup and return. Report loss, damage, injury, unsafe condition, or late return promptly through the Platform and cooperate to resolve the issue.
  • Owners and borrowers arrange pickup, handoff, and return directly. Unless the listing expressly says otherwise, ToolShare does not provide delivery, inspection, repair, insurance, or a guarantee of an item’s condition.
  • For vehicle rentals, the parties must complete the required physical document checks and comply with applicable licence, registration, insurance, road-safety, and vehicle-use requirements. The Platform’s checklist is not a substitute for legal verification.

Each owner and borrower is responsible for the rental agreement they make with each other. ToolShare provides the listing, request, communication, payment, and record-keeping features; it does not take possession of the item. Nothing in this section excludes responsibility imposed on ToolShare by law.

4. Work listings and engagements

  • Providers must describe the work, location, dates, skills, expected outcome, and pay accurately; have authority to offer the work; and communicate any material changes before work starts.
  • Workers should review the work details and terms, apply only when they can perform the work, follow agreed safety requirements, and communicate delays or completion promptly.
  • The provider and worker are responsible for agreeing the scope, schedule, work conditions, and any additional terms before work starts. They are responsible for their own conduct and for obligations that apply to them under employment, wage, tax, health, safety, licensing, and other laws.
  • ToolShare provides a marketplace and coordination tools. A listing, application, selection, or payment record alone does not create an employment, agency, partnership, or contractor relationship with ToolShare. The actual relationship and applicable law govern; this clause does not decide a person’s legal status or waive statutory rights.
  • ToolShare does not guarantee that a provider or worker will be suitable, available, qualified, or selected, and does not supervise or control work at the site. Providers remain responsible for a safe worksite, lawful instructions, required equipment, and any required insurance or permits.

5. Payments, fees, cancellations, and refunds

  • Prices, platform fees, payment methods, and any applicable taxes are shown in the Platform flow before payment. Review the total before confirming.
  • For paid rentals, the borrower’s rental amount is collected through an available payment method when due in the return flow. ToolShare deducts a platform fee of up to â‚č10 from the rental amount before recording the owner payout. The fee and payout breakdown are shown in the transaction flow.
  • For work, the provider pays the agreed job amount plus the currently stated â‚č10 provider platform fee. The worker payout is the agreed job amount; ToolShare does not currently deduct a worker platform fee. The Platform records and administers payouts according to the status and payment method shown in the account.
  • Gateway payments are processed by the payment provider shown at checkout and are subject to that provider’s terms. ToolShare does not store full card credentials.
  • Cancellation, failed payments, refunds, and disputes are handled under the flow shown in the Platform and applicable law. Contact support promptly with the ticket or transaction reference. A payment provider may separately apply its chargeback process.
  • Subscription, promotion, and other optional feature prices and durations are shown when purchased. Refund eligibility is determined by the purchase terms and applicable law; no blanket exclusion of statutory refund rights is intended.

6. User content, prohibited use, and enforcement

You retain ownership of content you submit. You give ToolShare permission to host, display, and use your listings, photos, messages, ratings, and related content as needed to operate, secure, and improve the Platform and to complete the transactions you request. You must have the rights needed to submit that content.

Do not misuse the Platform, impersonate another person, post false or unlawful content, infringe another person’s rights, harass users, evade payment, manipulate ratings, interfere with security, or use the Platform to arrange illegal or unsafe activity. We may investigate reports, preserve relevant records, remove content, limit accounts, or cooperate with lawful authorities when appropriate.

7. Complaints, disputes, and safety

For a Platform complaint, rental issue, work issue, payment problem, or safety concern, contact us through the Contact page and include the relevant request or work ticket ID. We will acknowledge and address complaints within the timelines required by applicable law. For immediate danger, contact local emergency services first.

Owners, borrowers, providers, and workers should first communicate through the Platform where safe and practical. ToolShare may help preserve records or route a complaint, but does not guarantee a particular outcome or replace a court, regulator, police authority, or other statutory remedy.

8. Platform availability and liability

We work to keep the Platform available and secure, but cannot promise uninterrupted or error-free service. To the extent permitted by law, ToolShare is not responsible for indirect loss arising from user-to-user transactions, inaccurate user content, or events outside our reasonable control. This does not exclude liability that applicable law does not allow us to exclude, including any liability arising from our own acts or omissions.

9. Applicable law and changes

These Terms are governed by the laws of India, including the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 where applicable, subject to mandatory consumer protections and other non-excludable rights. Disputes may be taken to any forum or authority with jurisdiction under applicable law.

We may update these Terms to reflect changes to the Platform or law. We will publish the revised version and update the date above. Where required, we will provide notice or seek renewed consent before the change applies.

10. Contact and legal notices

For questions, complaints, or legal notices, use the Contact page or email support@toolshare.app.
